Anti-spam Legislation Coming into Force Date Announced On December 4, 2013, the Ministry of Industry James Moore announced that that Anti-spam Legislation will come into force on July 1, 2014, press release link below.
As well, Industry Canada released the final form of their regulations for the Anti-spam Legislation, which will be published in the Canada Gazette on December 18, 2013. The regulations include a new exemption from the Anti-spam Legislation for registered charities, which will exempt commercial electronic messages that have as their "primary purpose" raising funds for the charity. Top Court to Hear Case on Withdrawal of Life-Sustaining Treatment
On December 10, 2012, the Supreme Court of Canada will hear a significant case about who decides when life-sustaining treatment may be withdrawn. The patient's physicians maintain that they can withdraw life-sustaining treatment without the consent of the substitute decision maker if it is no longer medically indicated and that to hold otherwise would encourage patients to insist on treatments that are medically futile. The patient's wife, who is his substitute decision-maker, takes the position that the medical measures are of benefit to her husband because they are keeping him alive and that he is entitled to remain alive until she thinks that that there is no hope for his recovery.
In the Rasouli case, the Supreme Court of Canada will determine whether the physicians can remove his life-sustaining treatment solely on the basis of their medical opinion or if they must obtain the consent of the substitute decision maker and, failing that, a ruling from the Consent and Capacity Board established under the Ontario Health Care Consent Act. The case is of particular interest to health care and religious charities and to those who are concerned about and reflect upon end-of-life decisions. Bill C-458 Supporting Canada's Charitable Sector Introduced Peter Braid, Member of Parliament for Kitchener-Waterloo, introduced Private Member's Bill C-458 Supporting Canada's Charitable Sector on October 31, 2012. If passed, the Bill would extend the tax deadline for charitable donations and would establish the last week of February each year to be National Charities Week. Bill C-458 proposes moving the tax deadline for charitable donations from December 31 to the end of February so that taxpayers who make charitable donations in the first 60 days of the new year can credit those donations against their income from the previous year. The expectation is that postponing the deadline from the time of year when people are thinking about holidays until the time when people are strategising about their finances would cause people to donate more. Meanwhile, MP Braid believes a National Charities Week would "highlight and celebrate our charitable sector and make Canadians proud to support the important work they do in our communities." The Report's Volume 5 on Terrorist Financing will be of particular interest to charities. Several of the recommendations contained in Volume 5 are encouraging for charities, specifically the following:
"It is essential that measures to defeat the use of charities or NPOs for TF [terrorist financing] not unnecessarily impede the valuable activities of legitimate organizations. Any new guidelines or best practices that the CRA may contemplate to help it address TF in the charitable sector should be developed in close cooperation with the charitable sector. The work of honest charities should not be hindered because of unrealistic guidelines or best practices."
